We provide fitness facilities, personal training, group classes, and related wellness services.
Membership at Straigiath is subject to acceptance of these terms and payment of applicable fees. We offer various membership levels with different access privileges and services. Membership fees are due monthly in advance and must be paid by the specified due date. We reserve the right to refuse membership or services to any individual at our discretion.
All members and guests must follow facility rules and conduct themselves respectfully. This includes proper use of equipment, maintaining cleanliness, respecting other members and staff, wearing appropriate workout attire and footwear, and following all safety guidelines. Failure to comply with facility rules may result in membership suspension or termination.
You acknowledge that physical exercise involves inherent risks and that you participate in activities at your own risk. You must disclose any health conditions that may affect your ability to exercise safely. We recommend consulting with a healthcare professional before beginning any fitness program. You must immediately report any injuries or safety concerns to our staff.
Membership fees are charged monthly and are non-refundable except as required by law. You authorise us to charge your designated payment method for all applicable fees. If payment fails, we may suspend your membership privileges until payment is received. Additional charges may apply for certain services, personal training, or facility damage.
You may cancel your membership with 30 days' written notice. We may terminate your membership immediately for violation of these terms, non-payment, or inappropriate conduct. Upon termination, you must return any access cards or equipment and your right to use our facilities ends immediately. We offer a 30-day money-back guarantee for new members who are not satisfied with our services.
All content on our website, including text, graphics, logos, images, and software, is the property of Straigiath or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without written permission. The Straigiath name and logo are trademarks of Straigiath B.V.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these terms. By using our services, you consent to our collection and use of your information as described in the Privacy Policy.
To the fullest extent permitted by law, Straigiath shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of our services or facilities. Our total liability for any claims shall not exceed the amount you paid for membership in the twelve months preceding the claim. This limitation applies whether the claim is based on contract, tort, or any other legal theory.
You agree to indemnify and hold harmless Straigiath, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our facilities, violation of these terms, or violation of any rights of another person or entity.
Straigiath shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, pandemics, or other emergencies. In such cases, we may temporarily suspend services without liability.
These terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Rotterdam, Netherlands. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website or notification to members. Your continued use of our services after changes are made constitutes acceptance of the new terms. We encourage you to review these terms periodically.
If any provision of these terms is deemed invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms of Service, together with our Privacy Policy and any membership agreement you sign, constitute the entire agreement between you and Straigiath regarding the use of our services and supersede all prior agreements and understandings.
